HEALTH AND SAFETY CODE CHAPTER 181
Sec. 181.105. REQUIRED INFORMATION REGARDING CONSUMER ACCESS TO HEALTH RECORDS AND COMPLAINTS. (a) Except as provided by Subsection (b), a covered entity shall prominently post on the entity’s Internet website and at any entity facility detailed instructions for a consumer to:
(1) request the consumer’s health care records from the entity;
(2) contact the disciplinary or licensing authority for the covered entity; and
(3) file a consumer complaint as described by Section 181.103.
(b) This section does not apply to a covered entity that conducts claims processing, data processing, data analysis, utilization review, or billing on behalf of another covered entity that provides health care services directly to consumers.

Your Rights Regarding Your Protected Health Information: You have the right to inspect and copy your health information, such as progress notes and billing records. You must submit a written request to the M.O.R.E. Heart & Soul Counseling & Consulting, PLLC privacy officer, Shy Seaman, M.Ed., LPC in writing either in person during regular business hours or via patient portal messaging in order to inspect and/or copy your information. If you request a copy of the information, we may charge a fee for the costs of copying, postage or other associated expenses. We prefer to send all PHI to clients via the patient portal being that this is the most secure method that will protect confidentiality of all clients and former clients. If you prefer to receive a printed copy of your PHI, please include this request in your written notice. We may only deny your request to inspect and/or copy in certain limited circumstances and with reasonable grounds. If you are denied access to your information, you may ask for your request to be reviewed.
The Right to an Accounting of Disclosures: You have a right to receive an accounting of disclosures of your health information made by
M.O.R.E. Heart & Soul Counseling & Consulting, PLLC, except for disclosures such as treatment, Center operations, and certain other
disclosures as provided for by law. To obtain an “accounting of disclosures” , you must submit your request in writing to the M.O.R.E. Heart & Soul Counseling & Consulting, PLLC privacy officer. It must state a time period, which may not be longer than six years. Your request should indicate in what form you would like the information provided (i.e., paper, email), as we may charge you for the costs of providing you this information. We will notify you of the costs involved and you may choose to withdraw or modify your request at that time before any costs are incurred.

Consumer Complaints and Communications to the Texas Attorney General ON THEIR WEBSITE: www.texasattorneygeneral.gov/consumer-protection/file- consumer-complaint How to prepare to file your online complaint:Before you begin to fill out your complaint form, make sure you have important information on hand, including the name of the business you’re complaining about and contact information for the business such as its full address. Be ready to complete the complaint form in full because the system cannot save your in-progress complaint. Tip: Do NOT hit the “back” button on your browser, or your submission will be cleared.The form asks you to provide a clear statement of the problem you are having. In this statement, include important information and relevant dates. Important information may include:
The name of the business or individual you’re filing a complaint
against;
- The business/individual’s full address, including zip code;
- A detailed description of your complaint;
- Transaction dates and amounts;
- Contract information;
- Payment information;
- Business websites and email addresses; and
- Any steps you have taken to resolve your complaint, including your communications with the business, the names of any people you spoke with, and their contact information.
If you wish to provide documents that support your complaint, be prepared to upload them. Supporting documents are not required but may be
helpful in understanding your complaint.
Complaints and Communications to the Federal Government If you believe that your privacy rights have been violated, you have the right to file a complaint with the federal government by contacting the OCR Regional Manager, Office for Civil Rights, U.S. Department of Health and Human Services (DHHS), 1301 Young Street, Suite 1169, Dallas, Texas, 75202, (214) 767-4056. Information is also available on the DHHS website at http://www.hhs.gov/ocr/privacy/. You will not be penalized for filing a complaint with the federal government
